DIVORCE FEE INCREASE SCRAPPED BY GOVERNMENT

The Ministry of Justice has scrapped plans to increase the divorce application fee from £410.00 to £750.00 after an adverse reaction to the proposed increase.

Reasons for not going ahead with the increase included:

  • Courts should not profit from the breakdown of marriages
  • There was no justification for the dramatic increase
  • People would be deterred from seeking a divorce
  • It was potentially discriminatory, as more women than men sought a divorce and it would therefore have a disproportionate impact on women
  • If the costs were higher, more people would stay in violent or unhappy marriages
  • Recent reforms to fee remissions would mean fewer people qualify and so more would struggle to pay the fee

The Ministry of Justice said a reduction could not be justified “in the current financial climate”
